Can Moes Southwest Grill require a site selection analysis for a proposed site?

Moes_Southwest_Grill Franchise · 2025 FDD

Answer from 2025 FDD Document

For any proposed site, we may require you to obtain a site selection analysis from an Approved Supplier, which may include an analysis of such factors as traffic patterns, demographics and competitors within the market. As you design and construct your Restaurant, you must hire an architect that we accept in writing to prepare your plans and make any necessary changes to our standard layout and specifications. In addition, you must hire a licensed and insured general contractor that we accept to complete the build-out of your Restaurant. Our acceptance of your architect or general contractor will not in any way be our endorsement of your architect or general contractor or render us liable for your architect's or general contractor's performance. When you

refresh or remodel your Restaurant, we may require you to obtain, at your expense, a site survey and design solution from us, our affiliates, or a designated vendor.

What This Means (2025 FDD)

According to Moe's Southwest Grill's 2025 Franchise Disclosure Document, Moe's Southwest Grill has the right to require franchisees to obtain a site selection analysis for any proposed restaurant location. This analysis must be conducted by an Approved Supplier and may include factors such as traffic patterns, demographics, and competitor analysis within the market. This requirement ensures that franchisees choose locations that meet Moe's Southwest Grill's standards for success.

Furthermore, Moe's Southwest Grill maintains control over the design and construction of the restaurant. Franchisees are required to hire an architect accepted in writing by Moe's Southwest Grill to prepare plans and make necessary changes to the standard layout and specifications. Additionally, a licensed and insured general contractor, also accepted by Moe's Southwest Grill, must be hired to complete the build-out. However, the FDD clarifies that Moe's Southwest Grill's acceptance of the architect or general contractor does not constitute an endorsement or liability for their performance.

Moreover, Moe's Southwest Grill may require franchisees to obtain a site survey and design solution from Moe's Southwest Grill, its affiliates, or a designated vendor when refreshing or remodeling their restaurant. This ensures that any updates to the restaurant align with the brand's current standards and image. The franchisee is responsible for the expense of this site survey and design solution. These measures allow Moe's Southwest Grill to maintain consistency and quality across all franchise locations, impacting the franchisee's initial investment and ongoing operational costs.
