Our Advertising. We are not obligated to conduct any advertising. We may periodically formulate, develop, produce, and conduct, at our sole discretion, advertising or promotional programs in such form and medium as we determine to be most effective. We may make available to you for you to purchase approved advertising and promotional materials, including signs, posters, collaterals, etc. that we have prepared.

What This Means (2025 FDD)
According to the 2025 Moes Southwest Grill Franchise Disclosure Document, Moes Southwest Grill may make available to franchisees the option to purchase approved advertising and promotional materials. These materials can include items such as signs, posters and other collateral that Moes Southwest Grill has prepared.
Beyond these optional purchases, franchisees are required to participate in advertising and marketing initiatives. Franchisees must make monthly advertising contributions to the Ad Fund, which is currently 3% of Net Sales, but may increase to 4% with notice. This contribution is in addition to local marketing obligations and grand opening obligations. Franchisees are generally required to use only advertising and promotional content that Moes Southwest Grill has furnished or approved in writing. This content includes a wide array of materials from branded items and press releases to digital marketing content.
Moes Southwest Grill maintains control over the Ad Fund and all advertising programs, including creative concepts and media used. Franchisees are also required to participate in temporary or permanent promotional campaigns established by Moes Southwest Grill or their Advertising Cooperative, bearing the costs to purchase or lease necessary materials. While franchisees can form Advertising Cooperatives, Moes Southwest Grill retains the right to approve all marketing programs and advertising materials of these cooperatives and can terminate or suspend their operations.
