5.4 Site Acquisition.
- A. Acceptance and Execution of Site Agreement. What This Means (2025 FDD)
According to the 2025 Moe's Southwest Grill FDD, the Site Agreement consists of either a signed lease, sublease, or other rental agreement (referred to as the "Lease") or a purchase agreement for the location (referred to as the "Purchase Agreement"). The franchisee must deliver a copy of the signed Site Agreement, including all material terms and any additional documents they were required to sign with it, to Moe's Franchisor SPV LLC.
Specifically, if Moe's Southwest Grill has identified the Accepted Location before the Franchise Agreement is signed, the franchisee must provide the Site Agreement after the Franchise Agreement is signed. If the location is accepted after the Franchise Agreement is signed, the franchisee must provide the Site Agreement immediately following the date the location is accepted.
A franchisee should ensure that the Site Agreement meets the requirements outlined in Section 5.4 of the Franchise Agreement before signing it. Moe's Southwest Grill retains the right, but not the obligation, to review the Site Agreement before it is executed to verify compliance with these requirements. Failure to provide the Site Agreement within 15 days of its execution may result in a Lease Documentation Late Fee of $500 per month (or partial month) until the document is delivered.
