What This Means (2025 FDD)
According to Moes Southwest Grill's 2025 Franchise Disclosure Document, there are currently no agreements in effect that would significantly limit a franchisee's right to use the franchisor's copyrights. Moes Southwest Grill claims copyrights on its manuals, recipes, building designs, architectural renderings, construction plans, and certain forms, advertisements, images, art, photography, promotional materials, and other written materials. Franchisees must adhere to the proper use and marking of these copyrighted materials as specified in the manuals.
Moes Southwest Grill also states that there are no currently effective determinations from the USPTO (United States Patent and Trademark Office), the Copyright Office (Library of Congress), or any court that involve any of their copyrights. Additionally, Moes Southwest Grill is unaware of any infringing uses or superior prior rights to their copyrights that could materially affect a franchisee's use of them in the state where their restaurant will be located. The franchisee's and franchisor's obligations to protect the franchisee's rights to use the copyrights are the same as the obligations for Proprietary Marks, as described in Item 13 of the FDD.
This indicates that as of the FDD's publication, a prospective Moes Southwest Grill franchisee should not encounter any known legal restrictions that would prevent them from utilizing the brand's copyrighted materials in their restaurant operations. However, it is important for franchisees to stay updated on any potential future changes or legal developments that could affect these rights.
