If Franchisor accepts a proposed site it shall notify Applicant in writing of its acceptance of the site ("Acceptance"), which Acceptance shall be subject to Applicant entering into a final lease or purchase agreement, and such other conditions as Franchisor may impose.

What This Means (2025 FDD)
According to the 2025 Marble Slab Creamery FDD, if Marble Slab Creamery accepts a proposed site for a new franchise location, they will notify the applicant in writing. This written notification is referred to as the "Acceptance".
This "Acceptance" is subject to the applicant entering into a final lease or purchase agreement, as well as any other conditions that Marble Slab Creamery may impose. The FDD states that if Marble Slab Creamery does not provide written notice of acceptance within 30 days of receiving the Real Estate Site Evaluation Package (or within 10 days of receiving additional requested information), the site is considered rejected.
It is important to note that the applicant proceeds at their own risk if they enter into any lease or purchase agreement for a site before Marble Slab Creamery issues its "Acceptance". The applicant must submit the proposed lease or real estate purchase agreement to Marble Slab Creamery within 60 days after receiving the "Acceptance". Marble Slab Creamery then has fifteen business days to notify the applicant of their acceptance or rejection of the proposed lease or real estate purchase agreement.
