What This Means (2025 FDD)
According to the 2025 Marble Slab Creamery Franchise Disclosure Document, the 'Accepted Location' is referenced within the context of the franchisee's operational rights and restrictions. Specifically, franchisees are permitted to use Marble Slab Creamery's proprietary marks only at the 'Accepted Location' or in advertising for the business conducted at or from that location. This means the physical store location approved by Marble Slab Creamery is central to where the franchisee can operate and promote their business under the brand's name and trademarks.
Marble Slab Creamery retains significant control over where franchisees can operate and how they can use the brand's trademarks. The franchisor has the right to conduct business activities, under any name, in any geographic area, and at any location, regardless of the proximity to or effect on the Accepted Location. This includes establishing franchises or company-owned outlets selling similar products, selling products through e-commerce, and advertising anywhere using the proprietary marks.
Furthermore, Marble Slab Creamery may offer franchisees the opportunity to operate a Satellite location within the same shopping center, mall, or venue as the Accepted Location, but this requires a separate Satellite Addendum and additional fees. Without this addendum, franchisees have no rights to operate additional Satellites. The franchisee may not relocate the Restaurant without Franchisor's prior written consent, which may be granted or withheld in Franchisor's discretion and may be subject to certain conditions.
