What This Means (2025 FDD)
According to Marble Slab Creamery's 2025 Franchise Disclosure Document, a franchisee may not relocate their restaurant without the prior written consent of the Franchisor. This consent can be granted or withheld at the Franchisor's discretion and may be subject to specific conditions.
These conditions include the Franchisor finding the new location satisfactory, the franchisee's lease for the new location complying with the Franchisor's current requirements, and the franchisee complying with the Franchisor's requirements for constructing and furnishing the new location. Additionally, the Franchisor must determine that the new location will not materially and adversely affect any other Marble Slab Creamery restaurant.
The relocated Marble Slab Creamery restaurant must be open and operating within 120 days from the closure of the original restaurant. The franchisee must have fully performed and complied with each provision of the Franchise Agreement within the last three years before the relocation request date. No event of default can exist as of the relocation request date, and the franchisee must pay a relocation fee of $2,000 to Marble Slab Creamery. Failure to meet any of these requirements, including reopening within 120 days, can result in the termination of the Franchise Agreement, even if relocation approval was initially granted.
