In unusual cases, if Franchisor, in its sole discretion, determines that the type of site being proposed by Applicant is of a type which Franchisor's designated vendor's Site Analysis tools are not designed to evaluate effectively, Franchisor may waive the required Site Analysis or may otherwise modify the requirements or specifications of the Site Analysis.

What This Means (2025 FDD)
According to Marble Slab Creamery's 2025 Franchise Disclosure Document, in unusual cases, Marble Slab Creamery may waive the required Site Analysis. This can occur if Marble Slab Creamery, in its sole discretion, determines that the type of site proposed by the applicant is not effectively evaluated by its designated vendor's Site Analysis tools. In such instances, Marble Slab Creamery may also modify the requirements or specifications of the Site Analysis instead of waiving it entirely.
This waiver or modification provides some flexibility for prospective franchisees who may have unique site proposals that don't fit the standard evaluation model. However, it's important to note that this decision rests solely with Marble Slab Creamery, and there's no guarantee that a waiver or modification will be granted.
Prospective franchisees should discuss potential site challenges with Marble Slab Creamery early in the process to understand if a waiver or modification of the Site Analysis might be considered. It is also important for the franchisee to understand that Marble Slab Creamery does not validate the reliability and accuracy of the Site Analysis and the franchisee shall hold them harmless on account of the use of the Site Analysis.
