What happens if a Marble Slab Creamery franchisee fails to use the designated architect?

We will designate the construction company, contractor, architect, kitchen designer, interior designer, kitchen equipment supplier, small wares provider, furniture supplier and approved signage manufacturer you must use to build or remodel the premises for your Restaurant. At your request, we may, in our sole discretion, allow you to engage an architect and contractor selected by you and acceptable to us, provided that if you engage an architect other than an architect designated by us, you must reimburse us for our costs and expenses incurred to review and have an architect acceptable to us review the designs and plans of your architect (See Item 6). You must provide us with all information necessary for us to evaluate your proposed architect and/or contractor, which may include satisfactory past restaurant construction or design experience, references, adequate financial resources and stability and evidence insurance. The construction company employs contractors and other personnel necessary to construct the Restaurant according to our specifications.

What This Means (2025 FDD)
According to Marble Slab Creamery's 2025 Franchise Disclosure Document, franchisees are generally required to use the architect designated by the company for building or remodeling their restaurant premises. However, a franchisee can request to use an architect of their choosing, subject to Marble Slab Creamery's approval.
If a franchisee chooses to engage an architect other than the one designated by Marble Slab Creamery, they must reimburse Marble Slab Creamery for the costs and expenses incurred to review the designs and plans of their architect. This includes the cost for an architect acceptable to Marble Slab Creamery to review the franchisee's architect's plans.
To gain approval for an architect, the franchisee must provide all necessary information for Marble Slab Creamery to evaluate the proposed architect. This information may include evidence of satisfactory past restaurant construction or design experience, references, adequate financial resources and stability, and proof of insurance. This process ensures that any architect used meets Marble Slab Creamery's standards, even if they are not the designated architect.
