Can Marble Slab Creamery grant exclusive rights to others for specific Off-Site Events?

Marble_Slab_Creamery Franchise · 2025 FDD

Answer from 2025 FDD Document

If you are in full compliance with the Franchise Agreement, and subject to the terms of the Franchise Agreement, you may operate temporary outlets for short-term periods at special events away from the site, such as fairs, sporting events, conventions, etc. ("Off-Site Events"). We reserve the right: (i) to designate specific types of Off-Site Events as approved or prohibited from time to time in the Manual; (ii) to grant exclusive rights to others for specific Off-Site Events; (iii) to impose geographic restrictions on the Off-Site Events at which you can do business; (iv) to impose restrictions on the types of products and services you can offer at Off-Site Events; and (v) to set other standards or policies for Off-Site Events that you must follow. You agree that you have no exclusive rights for any Off-Site Event, regardless of its proximity to your site, and that we and/or our other franchisees may seek and obtain the right to do business at any Off-Site Event instead of you.

What This Means (2025 FDD)

According to the 2025 Marble Slab Creamery Franchise Disclosure Document, Marble Slab Creamery retains significant control over off-site events. While franchisees can operate temporary outlets at special events like fairs and sporting events, Marble Slab Creamery reserves the right to grant exclusive rights to other parties for specific off-site events. This means that even if a franchisee is interested in operating at a particular event, Marble Slab Creamery can award that opportunity to someone else.

Marble Slab Creamery also has the power to designate which types of off-site events are approved or prohibited, impose geographic restrictions on where franchisees can operate off-site, and restrict the types of products and services offered at these events. Furthermore, Marble Slab Creamery can set other standards and policies for off-site events that franchisees must follow.

This lack of exclusivity and the broad control Marble Slab Creamery maintains over off-site events means that franchisees have no guarantee of being able to participate in these potentially lucrative opportunities. A franchisee may even find that Marble Slab Creamery or other franchisees are granted the right to operate at an off-site event in their territory, taking away potential business. Prospective franchisees should carefully consider these restrictions and the potential impact on their revenue when evaluating the Marble Slab Creamery franchise opportunity.
