Does a Marble Slab Creamery franchisee have to personally supervise the restaurant?

Answer from 2025 FDD Document

Under either the Single Restaurant Program or the Multi-Restaurant Program, you may also enter into a Management Agreement with us or our affiliate, if we agree (or our affiliate agrees) to do so. If we or our affiliate do sign a Management Agreement with you, we will provide you with additional advice regarding the operation and management of your Restaurant. The precise level of advice and service, and, if agreed upon, our obligation to manage your Restaurant and supervise your management and supervisory personnel and other employees will be identified in the Management Agreement. Except to the limited extent provided in the Management Agreement, if at all, neither we nor our affiliate perform other services, such as accounting, human resources, and record-keeping, and you will continue to be responsible for these.

What This Means (2025 FDD)

According to the 2025 Marble Slab Creamery Franchise Disclosure Document, franchisees may have the option to enter into a Management Agreement with Marble Slab Franchising, LLC or its affiliate. If such an agreement is in place, Marble Slab Creamery may provide advice regarding the operation and management of the restaurant, potentially including supervising management, supervisory personnel, and other employees. The specifics of this arrangement, including the level of advice and service provided, would be detailed in the Management Agreement.

However, it's important to note that without a Management Agreement, the franchisee retains the responsibility for services such as accounting, human resources, and record-keeping. This suggests that while Marble Slab Creamery can provide management assistance, it is not mandatory, and franchisees can manage their restaurants independently.

This flexibility allows Marble Slab Creamery franchisees to choose a management structure that best suits their needs and capabilities. A franchisee with extensive restaurant management experience may prefer to operate independently, while others may benefit from the additional support offered through a Management Agreement. Prospective franchisees should discuss the Management Agreement option with Marble Slab Creamery to fully understand the scope of services provided and determine if it aligns with their business goals.
