What This Means (2025 FDD)
According to Marble Slab Creamery's 2025 Franchise Disclosure Document, the franchise agreement is site-specific, and franchisees cannot relocate their restaurants without prior written consent from the franchisor. Marble Slab Creamery's approval for relocation is subject to several conditions.
These conditions include the new location being satisfactory to Marble Slab Creamery, the lease complying with their current requirements, adherence to construction and furnishing standards for the new location, and the new location not adversely affecting other Marble Slab Creamery restaurants. Additionally, the relocated restaurant must be open within 120 days of the original restaurant's closure, the franchisee must have fully complied with the franchise agreement in the three years prior to the relocation request, and there must be no existing default events.
Furthermore, Marble Slab Creamery requires a relocation fee of $2,000. The franchise agreement can be terminated if the franchisee fails to meet any of these relocation requirements, including reopening within the 120-day timeframe, even if initial approval was granted. This indicates that the franchise agreement is tied to a specific location, and any changes require franchisor approval and adherence to specific terms and conditions.
