What This Means (2025 FDD)
According to the 2025 Marble Slab Creamery Franchise Disclosure Document, the term 'master concessionaire' is defined within the context of 'Non-Traditional Venue/Excluded Venue'.
The FDD specifies that a 'Non-Traditional Venue/Excluded Venue' includes locations within another primary business, in conjunction with other businesses, or at institutional settings. These locations can include toll roads, highway travel plazas, hotels, casinos, airports, sports arenas, stadiums, bus stations, train stations, theme parks, military facilities, movie theaters, hospitals, grocery stores, convenience stores, schools, college campuses, piers, gyms, offices, shopping mall food courts operated by a master concessionaire, and any site where the lessor, owner, or operator prefers to limit food service operations to a master concessionaire or contract food service provider.
This definition is important for prospective franchisees because it clarifies the types of locations where Marble Slab Creamery may establish franchises without granting the franchisee territorial protection. If a franchisee's location is considered a 'Non-Traditional Venue/Excluded Venue,' Marble Slab Creamery retains the right to operate or license other Marble Slab Creamery restaurants in the same venue, even if it is within the franchisee's general market area. This could impact the franchisee's potential customer base and revenue.
