What This Means (2025 FDD)
According to the 2025 Marble Slab Creamery Franchise Disclosure Document, the term 'Development Area' is referenced in several sections pertaining to the franchisee's rights and obligations for multi-unit development.
Specifically, Section 3.1(a) outlines the franchisee's obligation to construct and operate restaurants within the Development Area, subject to certain conditions. This section indicates that the franchisee must adhere to the development schedule specified in Exhibit B of the agreement, opening the required number of restaurants within each Development Period.
Additionally, Item 23 discusses the franchisor's rights within and outside the Development Area, including the ability to operate or franchise other Marble Slab Creamery restaurants and market products through various channels. The Development Area's exclusivity depends on whether the franchisee selected 'Non-exclusive' or 'Protected Rights' in Section 2.1(b). If 'Non-exclusive' is selected, no territorial protection is granted. If 'Protected Rights' is selected, the franchisor will not open or license other Marble Slab Creamery restaurants within the Development Area during the term, subject to Reserved Rights.
