Answer from 2025 FDD Document

arks.

We offer 2 types of Restaurants: (a) Traditional Restaurants; and (b) Non-Traditional Restaurants. In addition, if you own and operate a Restaurant, in certain circumstances we will offer you the right to offer and sell products at a separate location that we approve ("Satellites"). Satellites may either be operated in conjunction with a Traditional Restaurant or a Non-Traditional Restaurant that is located in the same venue or shopping center. We will have the final authority to classify your Restaurant as Traditional or Non-Traditional.

We offer two separate franchise programs by this disclosure document, though we may not allow you the opportunity to purchase under all of these programs:

  • (a) Single Restaurant Program. If we approve your application to become a franchisee, you will sign a Franchise Agreement (Exhibit A) to operate a single Restaurant under our trademarks and in accordance with our system during the term of your Franchise Agreement. If you are purchasing an existing Restaurant, you will sign a Franchise Agreement.
  • (b) Multi-Unit Restaurant Program.

What This Means (2025 FDD)

According to Marble Slab Creamery's 2025 Franchise Disclosure Document, the franchisor, Marble Slab Franchising, LLC, retains the final authority to classify a restaurant as either Traditional or Non-Traditional. This classification is significant because it determines how the restaurant is perceived and operated within the Marble Slab Creamery system.

For prospective franchisees, this means that Marble Slab Creamery has the power to decide whether your location fits the criteria for a Traditional or Non-Traditional restaurant. This decision can impact various aspects of your franchise, including its appearance, menu offerings, and operational requirements. It is important to understand the distinctions between these classifications and how they align with your business goals.

Furthermore, if a franchisee is considering a co-brand restaurant, where Marble Slab Creamery operates alongside another brand, the franchisor's classification authority extends to these co-branded locations as well. The FDD states that if the Marble Slab Creamery restaurant is the dominant presence, it will be classified as Traditional, whereas if it is subordinate, it will typically be Non-Traditional. Marble Slab Creamery retains the final say in these classifications, which can affect the operational dynamics and brand representation of the co-branded location.
