What This Means (2025 FDD)

According to the 2025 Marble Slab Creamery FDD, if an applicant chooses to use a vendor other than Marble Slab Creamery's designated vendor for the Site Analysis, the applicant must either advance or reimburse Marble Slab Creamery for any costs and expenses the franchisor incurs to assist the applicant or the applicant's vendor in preparing the Site Analysis.

This means that if a prospective franchisee decides to use their own vendor for the site analysis, Marble Slab Creamery may charge the applicant for any assistance they provide to either the applicant or the applicant's chosen vendor. These costs could include Marble Slab Creamery's time, resources, and any external consulting fees they incur to ensure the site analysis meets their requirements.

It is important to note that Marble Slab Creamery does not validate the reliability or accuracy of the Site Analysis and assumes no liability for the applicant's use or reliance upon it. The FDD also states that no site evaluation tool can replace the human judgment of the applicant or their real estate professional, recommending that all sites be reviewed by both before a lease is executed or real estate is purchased.
