However, the FDD does state that if an applicant selects the 'Non-exclusive' option, Marble Slab Creamery retains the right to operate or franchise others to operate restaurants under the Marble Slab Creamery name at any location, including at Excluded Venues, regardless of their proximity to any Restaurant developed by the applicant. Similarly, even if an applicant selects the 'Protected Rights' option, Marble Slab Creamery still retains 'Reserved Rights' to operate or license others to operate restaurants at Excluded Venues.
