Can Management Recruiters waive the requirement for a franchisee to use a sole source vendor?

Franchisee agrees and acknowledges that in order to ensure continuity and compliance with the System, Franchisor may approve a vendor as the only provider of a particular good or service.
If Franchisor designates an approved vendor as the sole source of a good or service, unless waived by Franchisor in writing, Franchisee agrees to use such vendor as the sole source of a good or service.
Notwithstanding anything to the contrary contained in this Agreement, and this Section 10 in particular, Franchisee acknowledges and agrees that because complete and detailed uniformity under many varying conditions may not be possible or practical, Franchisor specifically reserves the right and privilege, at its sole discretion and as it may be deemed in the best interests of all concerned in any specific instance, to vary performance standards for some Franchisees based upon the peculiarities and characteristics of the particular franchise or circumstance, business potential, existing business practices or any other condition which Franchisor deems to be of importance to the successful operation of such particular franchise.
Franchisor has full rights to vary standard practices for any other franchisee at any time without giving Franchisee comparable rights.
Franchisee will not be entitled to require Franchisor to disclose or grant to Franchisee a like or similar variation.

What This Means (2024 FDD)
According to Management Recruiters' 2024 Franchise Disclosure Document, Management Recruiters may designate an approved vendor as the only provider of a particular good or service. Unless Management Recruiters provides a written waiver, the franchisee must use the designated vendor as the sole source for that good or service.
This means that as a Management Recruiters franchisee, you may be required to purchase certain goods or services from a specific vendor chosen by the franchisor. However, Management Recruiters retains the discretion to waive this requirement in writing, allowing you to potentially use an alternative vendor.
The FDD also states that Management Recruiters reserves the right to vary performance standards for some franchisees based on specific circumstances, business potential, or existing business practices. However, the franchisee is not entitled to demand the same variation granted to another franchisee, nor can they require Management Recruiters to disclose such variations.
