agreements under this Agreement, and otherwise bind themselves to the terms of this Agreement as stated herein, pursuant to the terms and conditions of the Nondisclosure and Noncompetition Agreement and Guaranty Agreement.
- 9.2. Best Efforts. Franchisee covenants and agrees that it will devote its full time and best efforts to operate the Franchise Business so as to achieve optimum business results. Franchisee shall commit at least 32 hours per week solely to the operation and success of the Franchise Business.
- 9.3. Appointment of General Manager. Franchisee, or one of Franchisee's Principals, shall be designated as the General Manager. If Franchisee or Franchisee's Principals cannot act as General Manager, Franchisee must hire a General Manager to direct the operation and management of the Franchise Business. Franchisee shall designate its General Managerto Franchisor in writing prior to attending Training. The General Manager must, during the entire period as General Manager, meet the following qualifications:
- the General Manager will meet Franchisor's standards and criteria for such individual, as set forth in writing by Franchisor and will be an individual otherwise acceptable to Franchisor in its sole discretion;
- the General Manager will devote his or her full time and best efforts to the supervision and management of the Franchise Business and may not engage in any other business activity without Franchisor's consent, which may be withheld in Franchisor's sole discretion; and
- the General Manager will satisfy the training requirements set forth in Section 8 herein.

What This Means (2024 FDD)
According to the 2024 Management Recruiters Franchise Disclosure Document, the General Manager must meet specific training requirements. If the franchisee or its principals cannot act as the General Manager, they must hire one. This General Manager has to be designated in writing to Management Recruiters before attending training.
The General Manager must meet Management Recruiters' standards and criteria, be acceptable to Management Recruiters at their discretion, and devote full time and best efforts to supervising and managing the franchise business, not engaging in other business activities without consent. Crucially, the General Manager must fulfill the training requirements outlined in Section 8 of the franchise agreement.
If the General Manager can no longer serve or doesn't qualify, the franchisee must inform Management Recruiters promptly and find a replacement within 30 days (or an extended time if granted by Management Recruiters). This replacement must meet the same qualifications, including completing all required training and obtaining necessary certifications. A principal who meets the qualifications can serve as the General Manager.
