What This Means (2024 FDD)

According to Management Recruiters' 2024 Franchise Disclosure Document, franchisees have extensive obligations to comply with all applicable laws, ordinances, and regulations. This includes, but is not limited to, laws relating to insurance, unemployment insurance, wage and hour, immigration, employment discrimination, and the withholding and payment of federal, state, and local income taxes. Management Recruiters franchisees must also obtain and maintain all required licenses, permits, and certificates related to operating the franchise and provide copies to Management Recruiters upon request. Franchisees bear the risk and financial responsibility for any expenses, costs, fines, or other consequences resulting from violations of employment, immigration, or Homeland Security laws. They are also responsible for reimbursing Management Recruiters for any related costs, such as insurance deductibles or expenses not covered by insurance policies, due to the franchisee's non-compliance. Franchisees must also notify Management Recruiters of any notices of non-compliance or legal actions within specified timeframes. These obligations are continuing and any failure to comply constitutes a material breach of the agreement. Franchisees must also adhere to ethical and professional standards in all business dealings. They are responsible for all obligations related to their core staff employees, including hiring, compensation, and training. Franchisees must also use the E-Verify system for temporary employees and verify their credentials.

While the FDD details the franchisee's legal obligations, it does not explicitly state how Management Recruiters supports franchisees in meeting these obligations within Item 11. Item 11 generally covers the franchisor's obligations, including pre-opening and ongoing support, training, and advertising. However, the provided excerpts do not specify how Management Recruiters assists franchisees in understanding and complying with the complex web of laws and regulations affecting their business.

Prospective Management Recruiters franchisees should seek clarification from Management Recruiters regarding the specific support and training provided to ensure compliance with all applicable laws. This could include legal updates, compliance manuals, training programs, or access to legal counsel. Understanding the extent of Management Recruiters' support in this critical area is essential for assessing the risks and responsibilities associated with the franchise.
