The Rights under this Agreement are cumulative and are in addition to any other rights and remedies available at law or in equity or otherwise; provided that, the parties intend that the remedy set out in Section 5 (Limited Warranty) is Franchisee's exclusive remedy for the Franchisor's breach of the limited warranty set out in Section 5 and the Limitation of Liability set forth in Section 6 shall limit the remedies available to Franchisee as set forth in Section 6.
