What This Means (2024 FDD)
According to Management Recruiters' 2024 Franchise Disclosure Document, Management Recruiters retains the right to vary performance standards for individual franchisees. Management Recruiters acknowledges that complete uniformity may not be possible or practical under varying conditions.
Specifically, Management Recruiters reserves the right to adjust performance standards based on the specific characteristics of a franchise, its business potential, existing business practices, or any other condition that Management Recruiters deems important for the franchise's successful operation. This allows Management Recruiters to adapt its expectations to the unique circumstances of each franchise location.
However, the FDD stipulates that Management Recruiters has full rights to vary standard practices for any other franchisee at any time without giving a franchisee comparable rights. Franchisees are not entitled to demand that Management Recruiters disclose or grant them similar variations. This clause emphasizes that any adjustments to performance standards are at Management Recruiters' sole discretion, potentially creating an uneven playing field among franchisees.
This discretion could impact a franchisee's business, as Management Recruiters could hold some franchisees to different standards than others. Prospective franchisees should consider this potential for differential treatment and discuss with Management Recruiters the conditions under which performance standards might be adjusted.
