What This Means (2024 FDD)
According to the 2024 Franchise Disclosure Document, Hire Quest does not provide any warranties that the services offered to Management Recruiters will be uninterrupted or error-free. Hire Quest explicitly states that it makes no warranties or representations of any kind for the services, which are provided on an "as is" and "as available" basis. This means Management Recruiters cannot expect a guaranteed level of service uptime or performance.
Specifically, Hire Quest disclaims all express or implied warranties, including those related to title, noninfringement, merchantability, or fitness for a particular purpose. Furthermore, any advice or information provided by Hire Quest or its representatives does not create a warranty. Hire Quest also does not guarantee that the services or any accessible data, information, software, or other material are free from viruses or harmful components, nor does it guarantee end-to-end bandwidth.
This lack of warranty has significant implications for a prospective Management Recruiters franchisee. It means that the franchisee bears the risk of service interruptions, errors, and potential data breaches. The franchisee is also responsible for ensuring their own internet connection and email services are properly set up and maintained. Given this, it would be prudent for a prospective franchisee to discuss potential service level agreements or other assurances with Hire Quest to mitigate these risks.
In the event of dissatisfaction with Hire Quest's services, the franchisee's sole remedy is to discontinue using the services. The franchisee assumes total responsibility and risk for using Hire Quest's servers and the Internet. This arrangement is not uncommon in franchising, where the franchisee often bears the responsibility for technology-related risks, but it underscores the importance of due diligence and careful consideration of the potential impact on business operations.
