What This Means (2024 FDD)

According to the 2024 Management Recruiters Franchise Disclosure Document, the standard agreement does not address punitive or exemplary damages. However, an addendum to the Management Recruiters Franchise Agreement required by the state of North Dakota specifically states that a franchisee in North Dakota does not consent to waive exemplary and punitive damages.

This means that for franchisees operating in North Dakota, the right to seek punitive or exemplary damages in disputes is preserved and cannot be waived by the franchise agreement. This addendum modifies the standard terms of the Management Recruiters agreement to comply with North Dakota law, which protects franchisees' rights in this regard.

For prospective Management Recruiters franchisees outside of North Dakota, the FDD does not provide specific information on whether the standard franchise agreement allows or prohibits waivers of punitive or exemplary damages. It is important for potential franchisees to consult with a legal professional to understand their rights and obligations regarding dispute resolution and damage claims in their specific jurisdiction.
