What This Means (2024 FDD)
According to Management Recruiters' 2024 Franchise Disclosure Document, the franchisee is considered the employer of individuals assisting with the day-to-day operations of the franchise business. Specifically, all persons employed or retained by the franchisee to assist with the daily operations (excluding temporary or contract employees) are the employees or agents of the franchisee, not Management Recruiters itself.
This distinction is important for several reasons. As the employer, the franchisee is responsible for all aspects of employment, including wages, benefits, and compliance with labor laws. Management Recruiters franchisees must understand their obligations as employers and ensure they are meeting all legal requirements. This also means the franchisee handles the hiring, training, and management of their staff.
To ensure clarity, Management Recruiters requires franchisees to disclose this relationship to all individuals they employ or retain. All materials provided to applicants must prominently state that the business is an independently owned and operated franchise of the MRINetwork, and that the applicant will not be an employee or agent of HQ MRI Corporation, the franchisor. This disclosure aims to prevent any confusion about the employment relationship and liability.
This arrangement is typical in franchising, where franchisees operate as independent business owners. While Management Recruiters provides the brand, system, and support, the franchisee is responsible for managing their own workforce and ensuring the smooth day-to-day operation of their business. Prospective franchisees should carefully consider these responsibilities and ensure they have the resources and expertise to manage employees effectively.
