Lees_Famous_Recipe Franchise · 2025 FDDAnswer from 2025 FDD Document
If you fail to comply with the Development Schedule, or otherwise materially default under the Area Development Agreement, then we may (in addition to our other remedies) terminate or modify your territorial rights, reduce the area of territorial rights, reduce the number of Restaurants that you may develop, or terminate the Development Agreement. When the Area Development Agreement expires or is terminated, you cannot develop additional Restaurants in the Development Area (but may complete development of and/or operate Restaurants under then-existing Franchise Agreements). We may develop or authorize others to develop, Lee's Famous Recipe Restaurants in the Development Area and exercise all rights not expressly granted to you under your Franchise Agreements.

What This Means (2025 FDD)
According to Lees Famous Recipe's 2025 Franchise Disclosure Document, the company has specific rights regarding the modification or termination of an Area Development Agreement. Lees Famous Recipe may terminate or modify a franchisee's territorial rights, reduce the area of territorial rights, reduce the number of Restaurants that the franchisee may develop, or terminate the Development Agreement if the franchisee fails to comply with the Development Schedule or otherwise materially defaults under the Area Development Agreement.
If the Area Development Agreement expires or is terminated, the franchisee cannot develop additional Lees Famous Recipe Restaurants in the Development Area, although they may complete development or operate Restaurants under then-existing Franchise Agreements. Lees Famous Recipe retains the right to develop or authorize others to develop Lees Famous Recipe Restaurants in the Development Area and exercise all rights not expressly granted to the franchisee under their Franchise Agreements.
These stipulations are important for prospective franchisees to understand, as failure to meet the development schedule or any material default can lead to a loss of territorial rights or termination of the agreement. This differs from a standard franchise agreement, as an Area Development Agreement involves a commitment to open multiple locations, making adherence to the development schedule critical. Prospective franchisees should carefully review the terms of the Area Development Agreement and ensure they have the resources and capabilities to meet the required development schedule to avoid potential penalties or termination.
