What This Means (2025 FDD)
According to the 2025 Lees Famous Recipe FDD, if Lees Famous Recipe rejects a proposed site, the franchisee cannot proceed with developing a restaurant at that location. Instead, the franchisee must continue searching for an acceptable site within their designated territory.
Furthermore, the FDD states that failure to secure an accepted site can lead to a default under the Franchise Agreement. If this occurs, Lees Famous Recipe has the right to terminate the Franchise Agreement, and any associated Area Development Agreement.
This highlights the importance of thorough site selection and due diligence on the franchisee's part, as well as the risk of losing the franchise if a suitable location cannot be found and approved by Lees Famous Recipe. Prospective franchisees should carefully consider the site selection criteria and seek guidance from Lees Famous Recipe to improve the likelihood of site approval.
