Is it the franchisee's responsibility to obtain necessary zoning and construction approvals and permits for a Lees Famous Recipe restaurant?

According to Lees Famous Recipe's 2025 Franchise Disclosure Document, franchisees are responsible for obtaining the necessary zoning and construction approvals and permits for their restaurant. Specifically, the franchisee must handle architectural services and building construction or remodeling contracts as required, and ensure equipment aligns with approved building and equipment plans. Lees Famous Recipe does not assist franchisees in conforming their restaurants to local ordinances or codes.

While Lees Famous Recipe does not obtain the permits, they do provide assistance with site selection. Lees Famous Recipe offers counseling in site selection and has the right to accept or reject all sites. However, they do not guarantee the suitability or success of the accepted site. The franchisor will review materials related to the proposed site, including a description of the location, feasibility study, demographic data, photographs, maps, artists' renderings, site plans, and a copy of the lease, if applicable.

Furthermore, the FDD states that the typical time between signing the Franchise Agreement and opening a Lees Famous Recipe restaurant ranges from 120 to 365 days. This timeframe depends on factors like site selection, lease negotiations, financing, and obtaining necessary zoning and building permits. Franchisees must open their restaurant within 12 months of signing the Franchise Agreement, unless otherwise agreed in writing with Lees Famous Recipe. Failure to open within this timeframe may result in termination of the Franchise Agreement.
