Answer from 2025 FDD Document

You cannot make any changes or substitutions to the Marks unless we so direct in writing. We reserve the right, in our discretion, to modify or discontinue use of any Mark, or to use one or more additional or substitute trademarks or service marks. In such event, you will, at your expense, comply with such modification or substitution, at your sole cost and expense, within a reasonable time after notice by us.

What This Means (2025 FDD)

According to the 2025 Lees Famous Recipe Franchise Disclosure Document, franchisees are not allowed to make any changes or substitutions to the Marks unless directed in writing by Lees Famous Recipe. Lees Famous Recipe retains the right to modify or discontinue any Mark, or to use additional or substitute trademarks or service marks. If such changes occur, the franchisee is responsible for complying with the modifications or substitutions at their own expense within a reasonable timeframe after receiving notice from Lees Famous Recipe.

This means a Lees Famous Recipe franchisee must use the Marks exactly as prescribed by the franchisor. They cannot alter logos, slogans, or any other designated trademarks or service marks without explicit written permission. This control ensures brand consistency across all franchise locations, which is a common practice in franchising.

The franchisee bears the financial responsibility for implementing any changes to the Marks directed by Lees Famous Recipe. This includes updating signage, marketing materials, and any other items bearing the Marks. Failure to comply with these directives can result in the franchisee being in breach of the franchise agreement, potentially leading to penalties or termination of the agreement.

This provision protects the integrity and uniformity of the Lees Famous Recipe brand. While it provides franchisees with a well-established brand identity, it also limits their creative control over marketing and branding elements. Prospective franchisees should be aware of these restrictions and prepared to adhere strictly to the franchisor's guidelines regarding the use of the Marks.
