Franchisee acknowledges and understands that computer systems are vulnerable to computer viruses, bugs, power disruptions, communication line disruptions, Internet access failures, Internet content failures, date-related problems, and attacks by hackers and other unauthorized intruders.
Franchisor has taken reasonable steps so that these problems will not materially affect the System.
Franchisor does not guarantee that information or communication systems supplied by Franchisor or its suppliers will not be vulnerable to these problems.
Franchisee acknowledges and agrees that Franchisee is solely responsible for protecting itself from these problems.
Franchisee must also take reasonable steps to verify that Franchisee's suppliers, lenders, landlords, customers, and governmental agencies on which Franchisee relies, are reasonably protected.
This may include taking reasonable steps to secure Franchisee's systems, including, but not limited to, firewalls, access code protection, anti-virus systems, and use of backup systems.

Furthermore, Learningrx franchisees have specific obligations regarding Customer Data. They must comply with data protection requirements outlined in the Operations Manual and the Franchise Agreement, as well as all applicable Privacy Laws, including assisting Learningrx in ensuring compliance. Franchisees are required to promptly notify Learningrx of any Security Incident, defined as any actual or suspected unauthorized access to Customer Data. They must also cooperate with Learningrx in investigating and remedying any noncompliance with Privacy Laws or the Franchise Agreement. This includes providing Learningrx with the ability to delete, access, or copy Customer Data and notifying them of any consumer requests regarding Customer Data. Franchisees must adopt and enforce policies and procedures that limit access to Customer Data to employees with a need-to-know basis and provide data privacy and security training to relevant employees. These measures ensure the confidentiality and protection of sensitive customer information, aligning with industry best practices for data security and privacy.
