8.8 Advertising and Promotional Programs. Franchisor will provide advertising and promotional programs as set forth in Section 9.
8.12 Website. Franchisor will provide information regarding Franchisee's Business on its Website, as set forth in Section 9.02.
9.4 Local Advertising.
Franchisee is required to promote the franchise and advertise on a local basis.
Franchisee will be required to spend the greater of Two thousand Dollars ($2,000.00) for a Micro Franchise and Three thousand and 00/100 Dollars ($3,000.00) for a Standard Franchise or five percent (5%) of Gross Revenues per month on local advertising and promotion.
Franchisee's entire Local Advertising minimum required amount must be paid to independent third parties.
Franchisee's failure to spend the Local Advertising amount required may result in the reduction or elimination of the Franchisee's Territory or the termination of this Agreement, in Franchisor's sole discretion.
- 9.5 Boost Marketing Program.
Franchisee must spend up to Three thousand and 00/100 Dollars ($3,000.00) per year for Boost marketing activities such as web directories, reputation management and other Boost marketing activities, initiated by and paid to Franchisor.
Any amount that Franchisee spends on the Boost Marketing Program will count towards Franchisee's local advertising requirements.
- 9.6 Center Marketing Program.
After the first year, the Center Marketing Program ("Center Marking Program"), will be required of a Center that generates less than Three hundred thousand and 00/100 Dollars ($300,000.00) gross revenue for a standard franchise or One hundred, fifty thousand and 00/100 Dollars ($150,000,00) for a micro franchise for the previous twelve (12) month period and the franchisee fails to meet its minimum marketing requirements for the past twelve (12) months.
Any amount that Franchisee spends on the Center Marketing Program will count towards Franchisee's local advertising requirements.

What This Means (2025 FDD)
According to the 2025 Learningrx Franchise Disclosure Document, Learningrx does provide advertising and promotional programs to franchisees as detailed in Section 9 of the agreement. Learningrx will also provide information regarding the franchisee's business on its website, as outlined in Section 9.02. However, franchisees are also required to engage in local advertising to promote their franchise.
Specifically, franchisees must spend a minimum amount each month on local advertising and promotion, with the amount being the greater of $2,000 for a Micro Franchise or $3,000 for a Standard Franchise, or 5% of gross revenues. These funds must be paid to independent third parties. Failure to meet the local advertising spending requirement could result in a reduction or elimination of the franchisee's territory or even termination of the agreement, at Learningrx's discretion.
In addition to local advertising, franchisees are also required to participate in the Boost Marketing Program, spending up to $3,000 per year on activities like web directories and reputation management, which are initiated by and paid to Learningrx. These Boost Marketing Program expenses can count towards the franchisee's local advertising requirements. Furthermore, after the first year, franchisees whose centers generate less than $300,000 in gross revenue for a standard franchise or $150,000 for a micro franchise and fail to meet minimum marketing requirements may be required to participate in the Center Marketing Program, with these expenses also counting towards local advertising requirements. Franchisees have the option to join advertising cooperatives with other Learningrx centers in their market area.
