What is the definition of 'Manager' in the context of operating a Learningrx franchise?

Learningrx Franchise · 2025 FDD

Answer from 2025 FDD Document

You and your designated Manager must attend training and complete the training to our satisfaction prior to opening your location. You and your designated Manager must complete the mandatory initial training program, to our satisfaction within 10 to 12 weeks of signing the Franchise Agreement. You will not be approved to open unless you have successfully completed Initial Training. We may, at our discretion, establish minimum completed assessment requirements that must be met before you will be approved to open, as outlined in the Operations Manual. If you do not successfully complete this training, you will be required to repeat the training under the same terms as initial training (no training fee but you must pay travel and living expenses). The cost of this training is covered by the Initial Training and Materials Fee for up to four persons. You will, however, be required to pay the travel and living expenses for you, your designated Manager, and your employee(s). All training, except any on-the-job training, will be held at our corporate headquarters in Colorado Springs, Colorado, or at another designated location and are held monthly. Notwithstanding the foregoing, we reserve the right to conduct any or all training virtually, as we determine in our sole discretion. After satisfactorily completing this initial training, there is no mandatory training required, however, you will be required to have center person per Center attend periodic or national conferences and we have the right to charge you a fine for not attending (See ITEM 6).

What This Means (2025 FDD)

Based on the 2025 Learningrx Franchise Disclosure Document, a franchisee must designate a 'Manager' who, along with the franchisee, is required to attend and complete the initial training program to Learningrx's satisfaction before the franchise location can open. This manager plays a crucial role in the Learningrx business model, as their successful completion of the training is a prerequisite for the franchisee to commence operations. The FDD emphasizes the importance of this designated manager by stating that the franchisee will not be approved to open unless both they and their manager have successfully completed the initial training.

The initial training for Learningrx, which the franchisee and their designated Manager must attend, takes place within 10 to 12 weeks of signing the Franchise Agreement. The cost of this training is covered by the Initial Training and Materials Fee for up to four persons. However, the franchisee is responsible for covering the travel and living expenses for themselves, their designated Manager, and any employees attending the training. This initial training is comprehensive and essential for ensuring that the franchisee and their manager are well-equipped to operate the Learningrx center according to the brand's standards and methods.

While the FDD mentions the requirement for a designated 'Manager' to undergo training, it does not explicitly define the specific roles, responsibilities, or qualifications of this position within the Learningrx franchise. A prospective franchisee should seek clarification from Learningrx regarding the expected duties, required skills, and level of authority that the 'Manager' should possess to effectively run the Learningrx center. Understanding these aspects is crucial for selecting a suitable candidate for the manager role and ensuring the smooth operation of the franchise.
