What This Means (2025 FDD)
According to Learningrx's 2025 Franchise Disclosure Document, Learningrx can access a franchisee's business records under certain conditions. Specifically, Learningrx or its representatives can access the business and computer systems to verify and secure a franchisee's compliance with the obligations outlined in the franchise agreement. Additionally, Learningrx is allowed to conduct a final inspection and audit of the franchisee's computer system, books, records, and accounts.
This access is crucial for Learningrx to ensure that franchisees are adhering to the standards, operating procedures, and other requirements detailed in the franchise agreement and operations manual. By having the right to inspect records and systems, Learningrx can monitor a franchisee's performance, ensure compliance with privacy laws related to customer data, and protect its trademarks and system standards.
Furthermore, in the event of termination of the franchise agreement, Learningrx retains specific rights regarding access to the franchisee's business. If a franchisee fails to remove all displays of Learningrx's marks from the center within thirty days after termination, Learningrx has the right to enter the center to remove them. Also, Learningrx can access records to protect its system and trademarks.
