The Franchisor will not require you to execute the Franchise Acknowledgement/Compliance Certification that is attached to the Franchise Agreement. If you do execute the Franchisee Acknowledgment/Compliance Questionnaire, we will disregard it and not rely on it.

What This Means (2025 FDD)
According to Kitchen Solvers' 2025 Franchise Disclosure Document, franchisees are not required to execute the Franchise Acknowledgement/Compliance Certification attached to the Franchise Agreement. If a franchisee does execute this document, Kitchen Solvers will disregard it and not rely upon it. This indicates that Kitchen Solvers does not require franchisees to formally acknowledge their receipt and understanding of the FDD.
However, it's important to note that addenda to the franchise agreement for specific states like North Dakota, New York, California, and Illinois include provisions stating that no statement, questionnaire, or acknowledgment signed by a franchisee can waive claims under state franchise laws or disclaim reliance on franchisor statements. This suggests that while Kitchen Solvers may not require a general acknowledgment, certain state-specific regulations aim to protect franchisees' rights regardless of any signed acknowledgments.
Furthermore, the addendum for Minnesota states that nothing in the Franchise Disclosure Document or agreements can reduce any of the franchisee's rights as provided for in Minnesota Statutes, Chapter 80C, or franchisee's rights to any procedure, forum, or remedies provided for by the laws of the jurisdiction. This reinforces the idea that franchisees' rights are protected by state laws, irrespective of any acknowledgments or waivers they may sign. Therefore, while Kitchen Solvers does not mandate an acknowledgment of the FDD, franchisees should be aware of their rights under state franchise laws, which cannot be waived through any such acknowledgments.
