After the Kitchen Solvers agreement expires, am I restricted from participating in a Competitive Business within another Kitchen Solvers franchisee's territory?

- 7.1.2 During the two (2) year period after expiration or termination of this Agreement, you and your owners, officers and agents will not directly or indirectly participate as an owner, director, partner, officer, franchisee, employee, consultant, advisor, salesperson, distributor, or agent or serve in any other capacity in any Competitive Business that is located: (a) anywhere in the Development Area; (b) within a twenty-five (25) mile radius of the Development Area; (c) within any other KITCHEN SOLVERS® franchisee's territory or within any area developer's development area; or (d) within twenty-five (25) mile radius of another franchisee's territory or another area developer's development area.

What This Means (2025 FDD)
According to Kitchen Solvers' 2025 Franchise Disclosure Document, following the expiration or termination of the Franchise Agreement, you are restricted from engaging in a Competitive Business within certain areas. Specifically, for a period of two years after the agreement ends, you (and your owners, officers, and agents) cannot participate in a Competitive Business as an owner, director, partner, officer, franchisee, employee, consultant, advisor, salesperson, distributor, or agent.
The restricted areas include not only your own Development Area and a 25-mile radius around it, but also any other Kitchen Solvers franchisee's territory or area developer's development area, as well as a 25-mile radius around those territories. This means that after your franchise agreement expires or is terminated, you cannot be involved in a competitive kitchen or bathroom remodeling business, cabinet refacing business, or any similar business that sells similar products or services within these defined geographic limitations.
This non-compete clause is designed to protect Kitchen Solvers' market and the interests of its franchisees and area developers. The term 'Competitive Business' is broadly defined to include not only businesses that directly compete in kitchen and bathroom remodeling but also those that franchise or license the right to operate such businesses. This restriction aims to prevent former franchisees from leveraging the knowledge and experience gained during their time with Kitchen Solvers to unfairly compete with the brand or its other franchisees within a specified timeframe and geographic area.
