What This Means (2024 FDD)
According to Kidokinetics's 2024 Franchise Disclosure Document, a franchisee has a limited right to copy the KIDOLINK Software. Specifically, a franchisee can only copy the software to the extent necessary to exercise the use granted by the franchise agreement and for back-up and archival purposes. This means that franchisees cannot freely distribute, share, or reproduce the software for any other reasons.
Kidokinetics prohibits franchisees from customizing or authorizing customizations of the KIDOLINK Software. The KIDOLINK Software is intended solely for the franchisee's internal use in operating their franchised business. Franchisees are not allowed to make the software available to any other person or entity, except as explicitly permitted within the franchise agreement.
Upon termination of the KIDOLINK Software license, the franchisee must promptly return or dispose of all physical copies of the software and its associated documentation as instructed by Kidokinetics. Additionally, the franchisee must remove all copies of the software from their computers and other electronic storage media. Kidokinetics may request written certification from the franchisee to confirm compliance with these requirements.
