What This Means (2024 FDD)

According to Kidokinetics' 2024 Franchise Disclosure Document, a franchisee must notify Kidokinetics, in writing, within five days of the commencement of any action, suit, or proceeding. This includes the issuance of any order, suit, or proceeding of any court, agency, or other government entity. Notification is also required upon receipt of any notice or citation.

This requirement ensures that Kidokinetics is promptly informed of any legal or regulatory issues that could affect the franchisee's operation or financial condition. This allows Kidokinetics to take appropriate action to protect its brand and system. The notification should be in writing to ensure a clear record of the communication.

For a prospective Kidokinetics franchisee, this means maintaining vigilance over any legal or regulatory matters affecting the business. Failure to notify Kidokinetics within the specified timeframe could have serious consequences, potentially leading to a breach of the franchise agreement. Franchisees should establish internal procedures to ensure timely reporting of any such events to Kidokinetics.

This type of notification requirement is common in franchise agreements, as franchisors need to be aware of potential liabilities or reputational risks associated with their franchisees' operations. The short timeframe underscores the importance of immediate action and communication in such situations.
