Does Kidokinetics have the right to develop or designate computer software programs for the Computer System?

According to Kidokinetics's 2024 Franchise Disclosure Document, Kidokinetics has the right, but not the obligation, to develop or designate computer software programs that franchisees must use in connection with any component of the Computer System.

Kidokinetics requires franchisees to install and maintain a computer system that complies with their standards and specifications. This includes an office computer, tablet, phone, fax machine, and potentially a custom point-of-sale (POS) system if Kidokinetics makes it part of their operating system in the future. Franchisees are also responsible for printers, backup systems, internet access, and security systems.

Kidokinetics can also require franchisees to install systems that allow Kidokinetics to electronically access and retrieve information stored in the franchisee's management software and other computer systems, including sales data. Franchisees must provide Kidokinetics with access to their office computer, tablet, smartphone, and management software. This includes usernames, passwords, IP addresses, and any other information needed for access.
