What hardware and software requirements must a Kidokinetics franchisee meet to access the internet?

According to Kidokinetics's 2024 Franchise Disclosure Document, franchisees must maintain adequate hardware and software to access the internet at the speed required by Kidokinetics. Franchisees must also maintain an electronic mail account with an Internet service provider acceptable to Kidokinetics. Franchisees are required to read all electronic mail related to their Kidokinetics business daily and acknowledge receipt of all electronic mail sent by Kidokinetics. Franchisees are prohibited from establishing any websites or other listings on the Internet, except as specifically permitted by Kidokinetics.

Kidokinetics may require franchisees to install and maintain systems that permit Kidokinetics to electronically access and retrieve any information stored in the franchisee's management software and other computer systems, including information concerning Gross Sales. Franchisees must provide Kidokinetics with a separate and distinct full access user name and temporary password, as well as all access codes and static internet protocol (IP) addresses to facilitate Kidokinetics's access to the data generated by and stored in the franchisee's computer, tablet, or smartphone.

Kidokinetics has established a website that provides information about the Kidokinetics system and the services offered by Kidokinetics franchises. Kidokinetics has sole discretion and control over the website, including whether to discontinue the website. Kidokinetics will provide franchisees with a dedicated page on the website for the franchisee's Kidokinetics business. Kidokinetics may require franchisees, at the franchisee's expense, to prepare all or a portion of the page using a template that Kidokinetics provides. All such information will be subject to Kidokinetics's approval prior to posting. Franchisees have no ownership or other proprietary rights to such page and will lose all rights to such page upon expiration or termination of their Franchise Agreement for any reason.

Franchisees are responsible for paying all fees and expenses for technology required by the Franchise Agreement, including the costs of computer hardware and software, Internet access, license fees, help desk fees, licensing or user-based fees for a franchise portal or a benchmarking platform, web page design, and fees related to exposure on Kidokinetics's website.
