What happens to the data stored in the KIDOLINK Software if the Kidokinetics agreement is terminated?

According to Kidokinetics's 2024 Franchise Disclosure Document, all data and information input and stored in the KIDOLINK Software is the sole and exclusive property of the Franchisor. This information is licensed to the franchisee for use solely for the direct and customary operation of the franchised business and only during the term of the agreement. Therefore, upon termination of the Kidokinetics agreement, the franchisee loses the right to use this data.

This means that a franchisee will not have access to any of the data they input into the KIDOLINK software after the agreement is terminated. This includes customer lists, sales records, inventory data, and any other information related to the business. The franchisee must also return or dispose of all physical copies of the KIDOLINK Software and its associated documentation as instructed by Kidokinetics, and remove all copies from their computers and other electronic storage media.

Kidokinetics may include a feature in the KIDOLINK Software that will cause the KIDOLINK Software to automatically cease to operate in whole or in part if the franchisee materially breaches the agreement, fails to submit required reports, or fails to pay required fees. The franchisee will not receive any refund of payments made to Kidokinetics if the license is terminated or the software is disabled. This could have significant implications for a franchisee's ability to transition their business or maintain customer relationships after the franchise agreement ends.
