Franchisee agrees, at its own expense, to keep its Computer System in good maintenance and repair and install such upgrades, additions, changes, modifications, substitutions, and/or replacements to Franchisee's Computer System or Required Software as Franchisor directs from time to time in writing.
Franchisee agrees its compliance with this Section 11.3.4 shall be at Franchisee's sole cost and expense.

What This Means (2024 FDD)
According to Kidokinetics's 2024 Franchise Disclosure Document, franchisees are required to install substitutions to the Computer System as directed by the franchisor. Specifically, Kidokinetics franchisees must keep their Computer Systems in good repair and install upgrades, additions, changes, modifications, substitutions, and/or replacements as directed by Kidokinetics in writing. The franchisee bears the expense of these changes.
Kidokinetics retains the right to develop or designate computer software programs for any component of the Computer System, including updates, supplements, modifications, or enhancements to the Required Software. Franchisees must install these at their own expense and are responsible for all associated fees.
This requirement ensures that all Kidokinetics locations operate with a standardized and up-to-date technology platform, which Kidokinetics believes is essential for maintaining system-wide uniformity and service quality. However, it also means that franchisees must be prepared for ongoing technology-related expenses and upgrades throughout the term of their franchise agreement.
