We have an advertising council composed of franchisees that advise us on advertising policies. The Franchise Agreement gives us the right, in our discretion, to create a franchisee advisory council to communicate ideas, including proposed advertising policies. According to Kidokinetics's 2024 Franchise Disclosure Document, the franchisor determines how franchisees are selected for the advertising council. The advertising council is composed of franchisees who advise Kidokinetics on advertising policies. Kidokinetics retains the right to create a franchisee advisory council to communicate ideas, including proposed advertising policies. Kidokinetics also reserves the right to change or dissolve the council at any time.
This means that Kidokinetics has complete control over the composition of the advertising council. As a prospective franchisee, you have no guarantee of being selected to participate in the council. Even if selected, Kidokinetics can remove you or dissolve the council entirely at its discretion.
This level of control is not uncommon in franchising, as franchisors often want to maintain brand consistency and marketing strategies. However, it's important for franchisees to understand that their input on advertising policies may be limited to the extent that Kidokinetics allows.
