What constitutes 'Franchisee Territory' as defined in the Kidokinetics System Protection Agreement?

According to Kidokinetics's 2024 Franchise Disclosure Document, the 'Franchisee Territory' is defined within the System Protection Agreement as the specific territory granted to the franchisee through the franchise agreement with Kidokinetics. This territory is more specifically detailed in Attachment B of the Franchise Agreement.

The Franchise Agreement grants the franchisee the right to operate their Kidokinetics business from a single location within the defined Territory, referred to as the 'Kidokinetics Business Location,' which is described and/or mapped in Attachment B of the agreement. Kidokinetics agrees not to operate or allow another franchisee to operate a Kidokinetics Business within the Territory using the same Marks, as long as the franchisee is compliant with the terms and conditions of the agreement.

It is important to note that while other franchisees may have home offices located within the Territory, they are not granted the right to operate within that Territory. Furthermore, the franchisee is restricted from operating outside their designated Territory without explicit written authorization from Kidokinetics.
