What This Means (2025 FDD)

According to the 2025 Jersey Mikes Franchise Disclosure Document, the Effective Date of the Franchise Agreement, as outlined in Paragraph 5 of the Franchise Agreement Summary Page, is defined in the context of an amendment to the original agreement. Specifically, for franchisees entering into an amendment, the Effective Date is not the date of the original agreement but rather the date ten years after the expiration date of the original franchise agreement.

This means that if a franchisee is renewing or amending their agreement, the start date of the renewed or amended agreement is calculated by adding ten years to the original agreement's expiration date. This clause appears to be designed to clarify the effective date in situations where the franchise agreement is being modified or extended, rather than when a new agreement is initially signed.

For a prospective Jersey Mikes franchisee, this is important to understand because it clarifies when the terms of the amended agreement come into force. It ensures that both the franchisee and Jersey Mikes are clear on the duration and commencement of the renewed or modified franchise terms. This could affect various aspects of the franchise operation, including royalty payments, advertising fees, and other obligations, as these may be subject to change upon renewal or amendment.
