Company and Licensee will agree to the hours of operation for the Licensed Restaurant and those hours will be set forth in Attachment A ("Opening Policy"). Notwithstanding the foregoing, Licensee will not be required to operate the Licensed Restaurant when the adjacent businesses at the Facility are not operating, provided that Licensee must provide Company written notice of the modified hours of operation. If the Facility imposes any restrictions on the hours of operation for the Licensed Restaurant, Licensee shall provide Company written notice of such restrictions for approval by Company.

What This Means (2025 FDD)
According to the 2025 Jack In The Box Franchise Disclosure Document, the hours of operation for a licensed restaurant are determined by agreement between the company and the franchisee, as detailed in Attachment A, referred to as the "Opening Policy".
However, a Jack In The Box franchisee is not required to operate the restaurant when adjacent businesses at the facility are not operating. In this case, the franchisee must provide written notice to Jack In The Box of the modified hours.
Additionally, if the facility imposes any restrictions on the hours of operation for the licensed Jack In The Box restaurant, the franchisee must provide written notice of such restrictions to the company for approval.
