What experience level is required for an Operator of a Jack In The Box franchise?

Jack_In_The_Box Franchise · 2025 FDD

Answer from 2025 FDD Document

Each franchised restaurant must have a designated "Operator" approved by the Company. The Operator may be you, someone else who has signed the Franchise Agreement, or, in some cases, someone you designate. The Operator must hold an ownership interest of at least 25% in the franchised business, and be highly experienced in the quick-service restaurant industry. In some circumstances, if you are qualified to be an Operator, have two years of ownership experience, and do not live in or near the Designated Market Area, we may permit you to name a Designated Market Operator to operate the restaurant. This Designated Market Operator need not hold an ownership interest in the business, but must otherwise satisfy the criteria to be an Operator, and other criteria we deem necessary, before he can be approved. In all cases, the Designated Market Operator must exercise his or her full time best efforts on the Jack in the Box restaurants in the Designated Market Area. In other rare circumstances, we may approve as an Operator someone who does not yet hold a significant ownership interest in the business, but is working under an employment contract with you that we believe will result in the Operator remaining in position for a significant period of time.

The Operator must be actively involved in the operation of the franchised business, but may act as the Operator for more than one Jack in the Box restaurant. The Operator must have authority to represent you in all dealings with the Company.

What This Means (2025 FDD)

According to Jack In The Box's 2025 Franchise Disclosure Document, each franchised restaurant must have a designated Operator approved by the company. The Operator may be the franchisee, someone else who has signed the Franchise Agreement, or someone the franchisee designates.

The Operator must have a minimum ownership interest of 25% in the franchised business and must be highly experienced in the quick-service restaurant industry. However, if the franchisee is qualified to be an Operator, has two years of ownership experience, and does not live in or near the Designated Market Area, Jack In The Box may permit the franchisee to name a Designated Market Operator to operate the restaurant. This Designated Market Operator need not hold an ownership interest in the business but must satisfy the criteria to be an Operator and other criteria Jack In The Box deems necessary before being approved.

In some rare cases, Jack In The Box may approve an Operator who does not yet hold a significant ownership interest in the business but is working under an employment contract that Jack In The Box believes will result in the Operator remaining in position for a significant period of time. In all cases, the Designated Market Operator must put forth their full-time best efforts in the Jack In The Box restaurants in the Designated Market Area. The Operator must be actively involved in the operation of the franchised business but may act as the Operator for more than one Jack In The Box restaurant and must have the authority to represent the franchisee in all dealings with the company.
