The term "you" as used in this Agreement is applicable to one or more Persons. All references to "including" shall be construed as references to "including, but not limited to".

  • 24.13.Time of Essence. Time is of the essence in this Agreement and every term thereof.
  • 24.14.Notices. All notices and notifications given under this Agreement must be in writing and must be delivered by: (a) hand delivery; (b) registered or certified air mail, postage prepaid, return receipt requested; (c) special delivery service (e.g., Federal Express, DHL, UPS, etc.); or (d) email, in each case to the following addresses (which may be changed upon 10 business days' prior notice):

What This Means (2025 FDD)

According to Itan's 2025 Franchise Disclosure Document, all notices and notifications given under the agreement must be in writing. These notices must be delivered through specific methods to ensure proper receipt and documentation.

Acceptable delivery methods include: (a) hand delivery, (b) registered or certified air mail with postage prepaid and return receipt requested, (c) special delivery service (such as Federal Express, DHL, or UPS), or (d) email. The notices should be sent to the addresses specified in Part A of ATTACHMENT "A" for the franchisee and to iTAN Franchising, Inc. at their San Marcos, California address, with attention to the Chief Executive Officer, or via email to Faraje@itan.com. Note that these addresses can be changed with 10 business days' prior notice.

The FDD also specifies when notice is deemed to have been given. Notice is considered given on the earliest of the following: (i) the date of hand delivery, (ii) the third business day after being placed in the mail or with a special delivery service, or (iii) the first calendar day after being sent by email.
