What This Means (2025 FDD)
According to Itan's 2025 Franchise Disclosure Document, the Franchise Owner Agreement must be signed by each of the undersigned owners of the franchisee. Additionally, the spouse of each owner who is a natural person must also sign the agreement. iTAN Franchising, Inc., as the franchisor, is also a party to this agreement. Each person who signs the agreement is referred to as "you" within the document.
This requirement ensures that all individuals with an ownership stake in the Itan franchise, as well as their spouses, are legally bound by the terms and conditions outlined in the Franchise Owner Agreement. This is a common practice in franchising to protect the franchisor's interests and ensure compliance with the franchise agreement.
For a prospective Itan franchisee, this means that if you have a business partner or co-owner, both of you will need to sign the Franchise Owner Agreement. Furthermore, if you or your business partner are married, your spouse will also be required to sign, acknowledging their awareness of the financial and legal obligations associated with the franchise. This is particularly important as it can affect marital assets and liabilities.
It is important for prospective franchisees to carefully review the Franchise Owner Agreement and understand their obligations before signing. Consulting with an attorney is advisable to ensure full comprehension of the agreement's terms and implications.
