What This Means (2025 FDD)

According to Itan's 2025 Franchise Disclosure Document, the maximum cure period Itan must provide a franchisee is 30 days. Specifically, Itan can terminate a franchise agreement if the franchisee fails to comply with any lawful provision of the agreement. However, Itan must first provide written notice of the failure and a reasonable opportunity to cure it.

The FDD states that this cure period, in no event, needs to be more than 30 days. This means that even if the nature of the breach would reasonably require more time to fix, Itan is not obligated to grant a cure period longer than 30 days. This 30-day period represents the maximum that Itan is required to offer.

It is important to note that this 30-day cure period is not applicable in all termination scenarios. Itan can terminate the agreement, effective immediately upon delivery of a termination notice, for certain events of default, such as insolvency, bankruptcy filings, seizure of the salon, or failure to complete initial training. In these situations, the franchisee does not have an opportunity to cure the default before termination.
