What information is included in the Site Approval Notice from Itan?

- "Site Approval Notice" means the Site Approval Notice attached as ATTACHMENT "B" that we may issue to you pursuant to §3 and §7.1 to identify the approved site for your Salon and your Territory.
If we approve the site for your Salon before signing this Agreement, we will describe your Territory in Part E of ATTACHMENT "A".
Otherwise, we will describe
your Territory in the Site Approval Notice we send to you after approving your site.
- If the site for your Salon has not been approved by us at the time this Agreement is signed, we will send you a Site Approval Notice in accordance with §7.1 listing the address of your approved site.*
If we approve the site for your Salon before signing this Agreement, we will list the address of your approved site in Part D of ATTACHMENT "A". Otherwise, we list the address of your approved site in a Site Approval Notice we send to you within 15 days after approving your site. Within five (5) business days after we send you the Site Approval Notice, you must sign and date the franchisee acknowledgment section and send us a copy for our records. Our approval of the site and designation of your Territory is immediately effective and binding on you at the time we issue the Site Approval Notice even if you do not send us a signed acknowledgment. Our approval of a site is not a representation or warranty of any kind, express or implied, of the suitability of the site for a Salon. It only means we believe the site meets our minimum criteria.

What This Means (2025 FDD)
According to Itan's 2025 Franchise Disclosure Document, the Site Approval Notice identifies the approved site for the salon and the franchisee's territory. Specifically, if Itan approves the site for the salon before the franchise agreement is signed, the territory will be described in Part E of ATTACHMENT "A". Otherwise, the territory will be described in the Site Approval Notice sent after Itan approves the site.
Furthermore, if the site for the salon has not been approved when the agreement is signed, Itan will send a Site Approval Notice listing the address of the approved site, according to §7.1. If Itan approves the site before signing the agreement, the address of the approved site will be listed in Part D of ATTACHMENT "A". Otherwise, the address of the approved site will be listed in a Site Approval Notice sent within 15 days after approving the site.
Within five business days of receiving the Site Approval Notice, the franchisee must sign and date the acknowledgment section and return a copy to Itan. Itan's approval of the site and designation of the territory becomes effective and binding upon issuance of the Site Approval Notice, even if the franchisee does not return a signed acknowledgment. However, Itan's approval of a site does not represent or warrant its suitability for a salon; it only indicates that the site meets Itan's minimum criteria.
